General business terms and conditions
(The following GBT& C contain statutory information regarding your rights according to regulations concerning both contracts in long-distance transactions and electronic commercial intercourse.)

1. General business terms and conditions

(1) These business terms and conditions apply for orders conducted by consumers. By ‘’consumer’’ is meant every individual and natural person who concludes a legal transaction with a purpose that can be ascribed neither to that person’s commercial nor autonomously occupational activity or function.

Our terms and conditions of sale apply exclusively: we do not recognise customers’ terms and conditions that either oppose or deviate from our terms and conditions of sale, unless we have specifically agreed to such in writing. Our terms and conditions of sale also apply even in such cases where we initiate and carry out delivery of goods to the customer in the knowledge that these either contravene or deviate from our own terms and conditions of sale.

(2) All agreements made between us and the customer concerning the execution of this contract are contained in writing within these general business terms and conditions.

(3) You have the right of revocation in accordance with the cancellation policy outlined below (section 10).

2. Contractual partner

The sales and purchasing agreement results from Novafon GmbH, managing director: Werner Kauffmann, Daimlerstr. 13, 71384 Weinstadt- Beutelsbach, Germany, registration office and number: District court, Stuttgart, HRB 26 35 32.

3. Range of products and conclusion of contract

3.1 The language adopted for the formation and conclusion of contracts is German.

3.2 For information regarding the major features and characteristics of the range of products we offer, as well as for the duration of limited offers, please refer to the individual product descriptions, particularly those contained within our range on the internet. For a variety of different reasons, the colour of the products depicted on the internet may differ from the original ( depending on the quality of your graphics card, how your monitor is adjusted, other reasons).

3.3 The contact arises according to the following terms:
(a) The presentation of our goods does not constitute a binding offer. Only when you (by clicking on „Bestellung abschließen“/’’complete your order’’) does the ordering of goods become a binding offer according to § 145 BGB (German Civil Code). The receipt of an order will be automatically confirmed by an email sent to the address stated on the order form. Along with a list of goods ordered and the total cost (individual and total costing, transport costs), this confirmation will also contain the valid GBT& C as well as our cancellation policy again. This electronic confirmation does not constitute the acceptance of your offer to complete the contract of sale, but simply documents that your order has been successfully received. Acceptance of the supply of goods on our part only occurs when a separate, explicit acknowledgement of order or bill of sale or delivery of goods is complete. This acceptance can ensue within one week after completing your order. Should the appliance ordered not be available, NOVAFON retains the right, either by email or in writing, to offer you goods similar in style, quality and price.

(b) NOVAFON will save your order details/data. After you have completed your order, an acknowledgement of receipt, which you are at liberty to print, will appear on your monitor screen. The email containing the confirmation of order is also printable.

4. Prices and shipping costs

4.1 Prices named on the product pages include statutory taxation and other price components.

4.2 In addition to the stated prices, we charge a flat rate of EUR 17.95 per order for shipping within Europe. Outside of Europe, we charge a flat rate of 35.90 euros.
We offer free delivery within Germany.

Further taxation or cost will not be incurred.

5. Contractual regulations concerning the cost of returning goods in conjunction with the statutory right of revocation.

5.1 You bear the regular cost of returning goods delivered, if these correspond to those ordered, and if the cost of the item to be returned does not exceed €40, or if, should it exceed this amount at the time of revocation, you have not rendered payment or a part payment as agreed per written contract. In other cases, the return of goods is free of charge.

5.2 Before returning goods per post, please contact us under the following telephone number +497151133970 in order to notify us thereof. By doing so, you will enable us to assign the products as promptly as possible. This will not affect your statutory rights of revocation.

6. Consignment

6.1 Shipment of goods is effected within Germany either with UPS or DHL.

6.2 The duration of shipment is, if not otherwise stated on the product page, 3 working days within Germany.


7. Conditions of Payment

7.1 The invoiced amount is to be paid either by advance payment, direct debit or by credit card. Direct debit as well as credit card payment is also possible via PayPal.

7.2 For payment in advance, we provide our bank details with the acknowledgement of order. Consignment will then follow after the payment has been received.

7.3 The client only has the right to compensation if his or her counterclaims are legally established, undisputed or acknowledged, or if these are recognised by us in written form. This does not apply if the counterclaims are due to faulty goods.

7.4 You can only reserve the right of retention insofar as such claims result from the same contractual relationship.

7.5 Your bank account will be debited at the time your order is accepted.

8. Reservation of ownership

All goods remain our property until payment has been made in full.

9. Guarantee

The guarantee is in accordance with the provisions of the law.

10. Cancellation Policy

Right of revocation

You are within your rights to revoke the contractual declaration in written form (e.g. letter, fax, email) within 14 days without specifying the reasons, or - if the item is relinquished to you prior to the expiry deadline – also by returning the item. This deadline commences upon the receipt of written notification and not upon the receipt of goods (in the case of recurrent shipment of goods of the same type, then not prior to receipt of the first shipment) and also not before completion of our obligation to provide information according to Article 246 § 2 in conjunction with Paragraph 1 and 2 of the Introductory Act to the German Civil Code as well as our obligations according to § 312g Paragraph 1, sentence 1 of the German Civil Code in conjunction with Article 246 § 3 of the Introductory Act to the German Civil Code. Punctual dispatch of revocation (or the goods) is sufficient to maintain the revocation deadline (2). The revocation should be addressed to:

Consequences of Revocation

In the case of an effective revocation, goods and services already provided and rendered by both parties are to be returned and, if applicable, resulting usage (e.g. interest) surrendered. Should you not be able to return or surrender the above in full or in mint condition, or should you return, surrender or compensate them only in part, you are obligated to provide compensation for the value thereof (e.g. benefits of usage). This obligation on your part only applies if the deterioration of the item or the resulting usage results solely from actions not normally resulting in connection with inspecting the characteristics or functions of the item. By ‘’inspecting the characteristics or functions’’ is meant the testing and trial of the respective item as would be possible and appropriate in retail premises. (9) Items, which cannot be returned per parcel shipment, are to be returned at our own risk. You bear the regular cost of returning goods delivered, if these correspond to those ordered, and if the cost of the item to be returned does not exceed €40, or if, should the item exceed this amount at the time of revocation, you have not rendered payment or a part payment as agreed per written contract. In other cases, the return of goods is free of charge. Items, which cannot be returned per parcel shipment, will be collected. Obligations connected with the refund of payments must be fulfilled within 30 days. For you, this term commences on the date of shipment of the declaration of revocation or of the item, and for us commences with its receipt.

Details of the goods ordered and the GBT&C will be sent to you per email. For security reasons, the text of the contract will no longer be available over the internet following completion of the order.
